🔴 بعد سنوات من التعذيب والعزل والمحاكمة، ورغم وجود ثغرات جوهرية في الملف: الاحتلال "يدين" الأسير نظمي أبو بكر من بلدة يعبد

رام الله – قالت هيئة شؤون الأسرى والمحررين ونادي الأسير الفلسطيني، إنّ المحكمة العسكرية في "سالم" أدانت الأسير نظمي أبو بكر من بلدة يعبد/ جنين، بتهمة القتل المتعمد، وذلك بعد ست سنوات على اعتقاله، وحددت جلسة خاصة للنطق بالحكم في شهر حزيران/ يونيو المقبل.

وأوضحت الهيئة والنادي أنّ طاقم الدفاع، المتمثل بالمحاميين رسلان محاجنة وخالد محاجنة، وهما محاميا هيئة شؤون الأسرى، أكدا وجود العديد من الثغرات والأدلة في الملف، والتي تؤكد براءة الأسير أبو بكر، إلا أنّ المحكمة العسكرية رفضتها جملةً وتفصيلاً، وأصدرت قراراً بإدانته بتهمة "القتل المتعمد".

وأكدت الهيئة والنادي أنّ الجهد الذي بُذل في هذه القضية على مدار ست سنوات، إلى جانب القرارات التي صدرت عن المحكمة العسكرية، وقرار الإدانة بحقّ الأسير أبو بكر، رغم الثغرات الجوهرية التي تضمنها الملف، يعكس مجدداً انعدام ضمانات المحاكمة العادلة أمام المحاكم العسكرية التابعة للاحتلال، والتي تشكّل على الدوام أداةً لتكريس سياسات القمع والعقاب بحقّ الفلسطينيين.

وأضافتا أنّ هذه المحاكم، ومنذ عقود، تفتقر إلى الحدّ الأدنى من معايير العدالة والنزاهة، وتعتمد إجراءات استثنائية تُقيّد حقوق المعتقلين في الدفاع والمحاكمة العادلة، بما في ذلك الاعتماد على الاعترافات المنتزعة تحت التعذيب، وحرمان المعتقلين من الضمانات القانونية الأساسية، الأمر الذي يجعل من قراراتها امتداداً لمنظومة الاضطهاد الاستعمارية بحقّ الشعب الفلسطيني.

يُذكر أنّ أبو بكر اعتُقل في 12 أيار/ مايو 2020، بعد أن ادعى الاحتلال أنّه تسبب بمقتل جندي إسرائيلي إثر إلقاء حجر (بلوك) من شقته. وفي حينه، شنت قوات الاحتلال حملة اعتقالات واسعة في بلدة يعبد، طالت عدداً من أفراد عائلة أبو بكر.

وبعد اعتقاله، تعرض أبو بكر لتعذيب وتحقيق قاسٍ جداً في معتقل "الجلمة"، وخلاله أنكر التهمة الموجهة إليه. كما حُرم من لقاء المحامي في المرحلة الأولى من التحقيق، وواجه العزل الانفرادي، وعُقدت له العديد من جلسات المحاكمة منذ اعتقاله عام 2020، وكان آخرها اليوم، حيث تمت إدانته دون النطق بالحكم النهائي.

وفي هذا الإطار، تشدد المؤسستان على المطلب الأممي الداعي إلى تفكيك نظام المحاكم العسكرية للاحتلال، كما تؤكدان ضرورة إنهاء حالة العجز الدولي الممنهج، ووقف الإبادة المستمرة بحقّ الأسرى في سجون الاحتلال الإسرائيلي.
 

🔴 After years of torture, isolation, and military trial, Israeli occupation “convicts” Palestinian of “murder” despite major flaws in case

Ramallah , occupied Palestine — The Commission of Detainees’ Affairs and the Palestinian Prisoner’s Society stated that the Israeli occupation’s “Salem military court” convicted Palestinian political prisoner Nazmi Abu Bakr from the town of Ya'bad/Jenin on charges of intentional murder, six years after his arrest. The court also scheduled a special session in June to issue the sentence.

The Commission and the PPS explained that the defense team, represented by lawyers Ruslan and Khaled Mahajneh — both lawyers for the Commission of Detainees’ Affairs — confirmed the existence of numerous gaps and pieces of evidence in the case file proving Abu Bakr’s innocence. However, the military court rejected them entirely and issued a conviction for “intentional murder.”

The two institutions stressed that the effort invested in this case over six years, along with the military court’s decisions and the conviction of Abu Bakr despite the fundamental flaws in the case file, once again reflects the absence of fair trial guarantees in the occupation’s military courts, which consistently serve as tools for enforcing policies of repression and punishment against Palestinians.

They added that these courts, for decades, have lacked even the minimum standards of justice and integrity, relying on exceptional procedures that restrict detainees’ rights to defense and fair trial guarantees, including dependence on confessions extracted under torture and depriving detainees of basic legal protections. This, they said, makes the courts’ rulings an extension of the colonial system of oppression imposed on the Palestinian people.

It is worth noting that Abu Bakr was arrested on May 12, 2020, after the occupation alleged that he caused the death of an Israeli soldier by throwing a stone block from his apartment. At the time, Israeli forces launched a wide arrest campaign in the town of Ya'bad, targeting several members of Abu Bakr’s family.

Following his arrest, Abu Bakr was subjected to severe torture and harsh interrogation at the “Jalameh” detention center, during which he denied the accusations against him. He was also denied access to a lawyer during the initial stage of interrogation and faced solitary confinement. Since his arrest in 2020, he has undergone numerous court hearings, the latest of which was today, when he was convicted without the final sentence being announced.

In this context, the two institutions reiterated the international demand to dismantle the occupation’s military court system and emphasized the need to end the systematic international failure to act and to stop the ongoing extermination against prisoners in Israeli occupation prisons.
